Terms of Use
These terms govern your access to and use of the Syndic+ platform. By creating an account, you agree to be bound by them.
These terms of use (the "Terms") form a contract between you (or the entity you represent, typically a condominium syndicate) and Syndic+ Inc. ("Syndic+"). They govern your use of the platform at syndicplus.ca and all associated services, applications, and APIs (the "Service"). If you accept these Terms on behalf of a syndicate, you confirm that you have authority to bind that syndicate.
1. Acceptance of the Terms
By creating an account, signing in to the Service, or clicking "I agree", you confirm that you have read, understood, and accepted these Terms as well as our Privacy Policy. If you do not accept these Terms, do not use the Service.
2. Service description
Syndic+ offers a software-as-a-service (SaaS) platform intended for Quebec condominium syndicates, covering: legal compliance (Bills 16, 25, 141), financial and accounting management, meetings and minutes, units and co-owners registry, maintenance logbook, insurance and claims management, dispute tracking, communications, co-owner requests, syndicate certificates, and common-space reservations. The Service evolves regularly; we may add, modify, or remove features, with notice for material changes.
3. Account creation and eligibility
You must be at least 18 years old and a resident of Canada (or represent an entity incorporated in Canada) to create an account. You are responsible for the accuracy of the information provided, for the security of your credentials, and for any activity performed under your account. You agree to notify us without delay of any unauthorized use.
4. Subscription, pricing, and renewal
The Service is offered through plans whose prices and limits are listed on the /pricing page. Paid plans are billed in advance monthly or annually, at your choice, and renew automatically at the end of each period until you cancel. Applicable taxes (GST and QST) are added to the listed price. We may change our prices by giving you at least 30 days' notice before renewal; the new price applies only to subsequent periods.
5. Payment — Stripe
Payments are processed by Stripe Payments Canada, Ltd. ("Stripe"). By providing your payment details, you agree to Stripe's terms (stripe.com/legal) and authorize the recurring charges corresponding to your subscription. Syndic+ does not store any full credit card number. If a payment fails, we will retry according to Stripe's rules for 21 days before suspending Service access.
6. Trial period
If your plan includes a trial period, it begins at account creation and lasts 14 days. At the end of the trial, your plan automatically converts to the corresponding paid plan unless cancelled beforehand. You can cancel at any time during the trial at no cost.
7. Cancellation and refunds
You can cancel your subscription at any time from /dashboard/settings/billing. Cancellation takes effect at the end of the current billing period, and no prorated amount is refunded except as required by applicable law. Payments already made are non-refundable, except: (a) where required by applicable law, (b) if we terminate the Service through no fault of yours, or (c) within the first 30 days after your first payment (money-back guarantee on written request).
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Quebec or Canadian law.
- Upload defamatory, hateful, discriminatory content or content that violates the privacy of others.
- Attempt to access accounts, organizations, or data that do not belong to you.
- Interfere with the integrity or performance of the Service (denial-of-service attacks, reverse engineering, unauthorized automated mass extraction).
- Bypass plan limits, quotas, or authentication mechanisms.
- Use the Service to send spam under Canada's Anti-Spam Legislation (CASL).
- Resell or host the Service on behalf of third parties without our prior written consent.
9. Your data
The syndicate remains the owner of the data it uploads or enters into the Service (the "Customer Data"). You grant us a limited, non-exclusive, worldwide license to use this data solely to provide, secure, and improve the Service. You can export your data at any time (PDF, Excel, CSV depending on the module). Upon termination, you have 90 days to export your data; after that period, it is deleted from our systems, except where longer retention is legally required.
10. Intellectual property
The Service, its source code, trademarks, interfaces, and documentation are owned by Syndic+ and are protected by Canadian and international copyright and intellectual property laws. These Terms grant you no right, license, or interest in those elements, except for the limited and revocable right to use the Service in accordance with the Terms.
11. Third-party services and integrations
The Service allows you to connect to third-party services (Microsoft 365, Google Drive, Dropbox, Stripe, Anthropic). Your use of these services is governed by their own terms and policies. Syndic+ disclaims any responsibility for the availability, performance, or acts of such third-party services. You are responsible for obtaining and maintaining the necessary OAuth credentials and for revoking access from /dashboard/integrations when no longer needed.
12. Privacy
The processing of personal information is governed by our Privacy Policy, which forms an integral part of these Terms. Syndic+ acts as a service provider under Bill 25 and processes personal information strictly according to the documented instructions of the syndicate.
13. No warranty
The Service is provided "as is" and "as available", without any express or implied warranty other than those mandated by law. Without limiting the foregoing, Syndic+ does not warrant that the Service will be uninterrupted, error-free, or free of data loss, nor that it will meet the specific legal compliance standard of each syndicate. The Service is a management aid; it does not replace the advice of a lawyer, notary, accountant, insurance broker, or professional property manager.
14. Limitation of liability
To the extent permitted by applicable law, Syndic+'s total liability arising from these Terms or your use of the Service is limited to the amount you paid to Syndic+ during the 12 months preceding the event. In no event shall Syndic+ be liable for indirect, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or opportunities, even if Syndic+ has been advised of the possibility of such damages.
These limitations do not apply to liability that cannot be limited by law (including intentional misconduct or gross negligence, bodily injury, or non-waivable obligations under the Consumer Protection Act where it applies).
15. Termination
You may terminate your account at any time. Syndic+ may suspend or terminate your access, with or without notice: (a) in case of a material breach of these Terms, (b) for fraudulent use, (c) when legally required, or (d) to discontinue the Service as a whole upon 90 days' prior notice.
16. Changes to the Terms
We may modify these Terms. Material changes will be communicated by email and via an in-app banner at least 30 days before they take effect. By continuing to use the Service after that date, you accept the modified Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising under these Terms will be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, to the exclusion of any other jurisdiction, except where a mandatory provision of the Consumer Protection Act provides otherwise.
18. Amicable dispute resolution
Before any judicial recourse, the parties commit to attempting to resolve the dispute in good faith. You may also file a complaint with Quebec's Office de la protection du consommateur (opc.gouv.qc.ca) or, for privacy matters, with the Commission d'accès à l'information (cai.gouv.qc.ca).
19. Severability and entire agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any separately concluded data processing agreement, constitute the entire agreement between you and Syndic+ regarding the Service.
20. Language
In accordance with the Charter of the French Language (CQLR, c. C-11), as amended by Bill 14 (formerly Bill 96), these Terms are drafted in French and made available in English. In case of discrepancy, the French version prevails.
